Competition Terms and Conditions

1. PROMOTER

This competition is organised by Hendler & Hart (Pty) Ltd (“the Promoter”), registration number 2000/014361/07.

2. COMPETITION PERIOD

The competition opens on 2 October 2026 and closes at 23:59 South African Standard Time on 31 January 2027.

Entries received outside this period will not qualify.

3. ELIGIBILITY

The competition is open to individuals aged 18 years or older, residing in South Africa, who have a valid Facebook account.

The following people are excluded:

  • Directors, members, partners, employees, agents and consultants of the Promoter or any entity that directly or indirectly controls, or is controlled by, the Promoter.
  • Suppliers of goods or services connected with this competition.
  • The spouses, life partners, parents, children, siblings and business partners of the above persons.

Participants must own the Hart pot entered or have its owner’s permission to enter it and make it available for reasonable verification. The prize will be awarded to the eligible entrant, and permission from the owner does not create a separate entitlement to the prize.

4. HOW TO ENTER

During the competition period:

  1. Take a clear, original photograph of your genuine Hart pot.
  2. Post the photograph in the comments of an official competition post on the Hart Homeware Facebook page.
  3. State approximately how old the pot is. Where possible, explain how you know its age, such as when it was purchased or inherited.

Any reference to “average age” in the competition artwork means the approximate age of the pot.

No new purchase or entry fee is required. Participants are responsible for their normal internet or mobile data charges.

Liking, following, sharing or tagging other people is not compulsory and does not improve a participant’s chances of winning.

Participants may enter more than one distinct Hart pot. Each pot may be entered only once. Duplicate entries of the same pot, including across different official competition posts, will be treated as one entry.

Entries must remain accessible until recorded by the Promoter. Participants may withdraw an entry by contacting info@hendler.co.za.

5. QUALIFYING PURCHASE

The photograph must show the actual pot being entered. Stock photographs, photographs used without permission and images generated or altered to misrepresent the pot are not permitted.

Participants must have the necessary rights and permissions to submit their photographs and accompanying information.

Participants must not post identity documents, home addresses, telephone numbers or other sensitive personal information in public comments. Photographs should not include identifiable people without their permission.

Fraudulent, automated, deliberately misleading or materially non-compliant entries may be disqualified. An honest estimate of a pot’s age will not, by itself, be treated as dishonesty.

6. PRIZE

There will be one winner: the eligible participant whose entered Hart pot has the oldest age that the Promoter can reasonably substantiate among qualifying entries received.

Selection is based on the pot’s verified age, rather than likes, shares, popularity, photograph quality or the quality of the accompanying story.

The Promoter’s assessment panel will consider relevant evidence, including:

  • Hart branding, stamps, markings and product design.
  • Available manufacturing records, historical catalogues and product information.
  • Dated receipts or photographs.
  • Credible information about when the pot was purchased, inherited or used by the family.
  • Additional photographs, video or a reasonable inspection of the pot.

An original receipt is not compulsory. A participant’s stated age alone will not automatically establish the pot’s age. Wear and appearance alone will not be treated as proof.

Where evidence supports only an age range, the panel will use the youngest age reliably supported by that evidence. The same assessment approach will apply consistently to all entries.

Shortlisted participants may be asked to provide further evidence within 10 business days of receiving a verification request. Reasonable extensions may be granted where justified.

If physical inspection or transport of a pot is required, the Promoter will arrange and pay the reasonable associated costs. Ownership of the pot remains with its owner.

If two or more qualifying entries are tied for the oldest reasonably substantiated age, one winner will be selected through a documented random draw among those tied entries, overseen by an independent accountant, registered auditor, attorney or advocate.

The winning entry represents the oldest reasonably verified pot among qualifying entries received. It does not establish that the pot is definitively the oldest Hart pot in South Africa.

The Promoter will document the assessment process and arrange independent oversight and certification of the competition.

7. DRAW

One winner will receive a hamper of Hart products with a total retail value of R5,000, including VAT.

The Promoter will select the products included in the hamper. The R5,000 value refers to the products and excludes delivery costs.

The prize is a product hamper. It is not cash or a shopping voucher, and no cash alternative is available.

The prize may not be transferred before delivery without the Promoter’s agreement.

The Promoter will arrange and pay for delivery to the winner’s agreed address within South Africa. No claim, administration or delivery fee will be charged.

The winner is not required to surrender their old pot or purchase any product to receive the prize.

Applicable statutory consumer rights and product warranties remain available.

8. WINNER VERIFICATION AND NOTIFICATION

The Promoter aims to complete verification and notify the provisional winner by 26 February 2027. If verification reasonably requires more time, an update and revised timetable will be published on the official Hart Homeware Facebook page.

The provisional winner will be contacted through the official Facebook page, including by replying to their entry and, where possible, by private message.

The provisional winner must respond within 10 business days of the first notification. The Promoter will make at least two reasonable contact attempts during that period.

The Promoter may privately request information reasonably necessary to confirm identity, age, South African residence, eligibility and delivery details. Identity documents must never be posted publicly.

If the provisional winner cannot be contacted, declines the prize, is ineligible or does not complete reasonable verification within the stated period and any justified extension, the next qualifying entry will be considered under the same selection rules.

Delivery will be arranged within 30 business days after the winner is confirmed and provides the necessary delivery details. Any unavoidable delay will be communicated to the winner.

For these rules, a business day is a Monday to Friday, excluding South African public holidays.

9. REDEMPTION OF THE PRIZE

Hendler & Hart (Pty) Ltd, at the address stated in Section 1, is the responsible party for personal information it processes to administer this competition.

Information processed may include participants’ Facebook names, photographs, comments, pot history, correspondence and verification evidence. Contact, identity and delivery information will be requested privately where reasonably necessary.

Personal information will be used to:

  • Administer and record entries.
  • Verify eligibility and the age of entered pots.
  • Select and contact the winner.
  • Arrange prize delivery.
  • Prevent fraud and meet legal obligations.

Providing the information required for entry and reasonable verification is necessary to participate. If it is not provided, the Promoter may be unable to assess an entry or award the prize.

Information may be shared, only as necessary, with authorised competition administrators, assessors, independent professional overseers, delivery providers and authorities where legally required. Appropriate confidentiality and security safeguards will be required from service providers.

Public Facebook comments and photographs may be viewed by others. Meta processes information under its own terms and privacy policies and may process it outside South Africa. Any cross-border transfer arranged by the Promoter will comply with applicable POPIA requirements.

Competition records required by law will be retained for at least three years after the competition ends. Other personal information will be retained only for as long as reasonably necessary for the stated purposes, then securely deleted or de-identified, subject to lawful retention requirements.

Participants may request access to or correction of their personal information, object to processing where applicable, or request deletion subject to lawful retention requirements by emailing info@hendler.co.za or calling 011 898 6300.

Participants may also lodge a complaint with the South African Information Regulator through https://inforegulator.org.za/complaints/.

Entering this competition does not subscribe a participant to marketing communications. Any marketing subscription will require a separate, voluntary opt-in. Refusing or withdrawing marketing consent will not affect entry or entitlement to the prize.

10. PUBLICITY

Submitting an entry permits the Promoter to access and use it for competition administration, assessment, verification and legally required record keeping.

Promotional reuse of a participant’s photograph, story or image, or publication of the winner’s name, will require separate permission.

The winner may decline promotional photography, interviews, appearances or publication of their personal details without losing the prize. The Promoter may announce that a winner has been selected without identifying them.

11. PERSONAL INFORMATION AND POPIA

This competition is not sponsored, endorsed, administered by or associated with Facebook or Meta.

To the extent permitted by South African law, each participant releases Facebook and Meta from liability arising from this competition.

Information collected for competition administration is provided to the Promoter. Use of Facebook remains subject to Meta’s own terms and privacy policies.

12. VERIFICATION AND DISQUALIFICATION

The Promoter will apply these rules fairly and consistently. Participants may raise concerns about eligibility, verification or selection by contacting info@hendler.co.za.

The panel’s determination concludes the Promoter’s internal selection process. It does not prevent participants from seeking relief through a regulator, court or other lawful dispute-resolution process.

The Promoter may amend, suspend or cancel the competition only where reasonably necessary because of a legal requirement or circumstances beyond its reasonable control. Any material change and its reason will be communicated promptly through official competition channels.

Changes will not unfairly prejudice participants or remove rights already acquired.

Nothing in these rules excludes liability that cannot lawfully be excluded, including liability for gross negligence, or limits participants’ rights under the Consumer Protection Act or POPIA.

If no eligible entry can be reasonably verified, the Promoter will publish an explanation and address the outcome fairly and in accordance with applicable law.

The competition is governed by the laws of South Africa.
